MICHIGAN LAW FIRMS REPRESENT WOMEN VICTIMS OF DETROIT DOCTOR’S MISCONDUCT

June 22, 2022

Helping injured women patients of Ascension cancer doctor

[Detroit, MI] —Together the Buchanan Firm of Grand Rapids and Olsman MacKenzie Peacock & Wallace of Detroit are representing women patients injured by Ascension Health’s gynecologic oncologist Vinay Kumar Malviya MD.

Dr. Malviya treated patients at Ascension hospitals in Michigan from 2011 to 2017. Women patients allege that Dr. Malviya performed medically unnecessary surgery procedures on them, including radical hysterectomies and excessive chemotherapy. As a result, the women claim they suffered serious and irreparable harms and losses from the misconduct. In April 2022, the U.S. Department of Justice punished Dr. Malviya for unnecessary surgeries and chemotherapy on women in those years, after medical coworkers alerted law enforcement in 2017.

Dr. Malviya performed unnecessary procedures and treatments at Ascension hospitals in Michigan, including:

  • Providence Park Hospital in Southfield, Michigan
  • St. John Hospital and Medical Center in Detroit, Michigan
  • St. John Macomb Oakland Hospital in Warren, Michigan; and
  • Ascension Crittenton Hospital in Rochester, Michigan.

Patients treated by Dr. Malviya should contact the law firms immediately to protect their legal rights before they expire forever.

Whistleblowers Alerted Federal Government in 2017 of Dr. Malviya’s Misconduct

In July 2017, three whistleblowers alerted the U.S. government under the False Claims Act that a gynecologic oncologist was performing medically unnecessary procedures on women patients, and that Ascension hospitals in Michigan were profiting from those procedures. Last year, Ascension Michigan admitted the charges and was ordered to pay $2.8 million to reimburse the government for services provided by the doctor that were characterized as overtreatment, both surgical and non-surgical. The doctor’s identity was not revealed to the public.

However, on April 14, 2022, the Department of Justice revealed the identity of the gynecologic oncologist who had performed these medically unnecessary procedures on women as Vinay Malviya MD. The Department announced that Malviya agreed to pay $775,000 to resolve False Claims Act allegations against him. Malviya also agreed to be excluded from Medicare, Medicaid, and all other federal health care programs for a term of three years.

Allegations against Malviya were that he performed radical hysterectomies when only simple hysterectomies were medically necessary, that he administered and ordered excessive chemotherapy over what was medically necessary, and that he was paid for evaluations and management services not performed or not rendered as represented.

Michigan Medical Malpractice Attorneys Ready to Fight for Women Patients Dr. Malviya Injured

Rob Buchanan, managing partner of the Buchanan Firm, remarked:

“Women patients put their trust in Dr. Malviya to appropriately treat their illnesses, diagnose their medical conditions, and perform only necessary surgical procedures and treatments. However, Dr. Malviya violated that trust, performing unnecessary surgery procedures and injecting excessive chemotherapy, causing serious and life-changing harms and losses to many of these women. These women and their families deserve reimbursement for the harms and losses caused by the doctor’s medical malpractice.”

Buchanan has been recognized as one of Michigan’s top medical malpractice attorneys by The Best Lawyers in America, Super Lawyers, and Martindale-Hubbell’s “Preeminent Lawyers.” He has a long and distinguished record of sizable settlements and jury verdicts for injured patients. Buchanan also served as President of the State Bar of Michigan from 2020 to 2021, representing all attorneys in the state.

Donna MacKenzie, a partner and medical malpractice attorney at Olsman MacKenzie Peacock & Wallace, said she is pleased to combine forces with Buchanan Firm:

“The experience and expertise of our two law firms protecting the rights of these women will greatly benefit our clients seeking full and fair compensation for the misconduct of Dr. Malviya.”

MacKenzie has received numerous awards and recognition for her work, including being recognized by Crain’s Detroit Business as one of Michigan’s Most Notable Women Lawyers in 2017; named to the Michigan Top 100 Super Lawyers list from 2015-2020; and being recognized by Best Lawyers in America as Medical Malpractice “Lawyer of the Year” in 2016, 2018, and 2020. Of her many victories, MacKenzie negotiated an $8 million settlement for victims of a physician at one of the largest cancer practices in Michigan, who misdiagnosed patients with cancer. She also won a $4.4 million verdict for a woman injured as a result of a medication error by her doctor.

The attorneys at Buchanan Firm and Olsman MacKenzie are passionate advocates for injured patients. They are now representing the women injured by Vinay Kumar Malviya MD at Ascension hospitals in Michigan and at his doctor’s office.

“As seasoned medical malpractice attorneys, Donna and I always helpthe individual, the underdog against big medical systems to right wrongs,” Buchanan said. “We both enjoy being our clients’ metaphoric David fighting the powerful Goliaths.”
